In June of 2003, the DOJ issued a document appropriately entitled, “Accessibility of State and Local Government Websites to People with Disabilities.” References were made to Section 508 accessibility Standards and Web Content Accessibility Guidelines (WCAG). By 2010, the DOJ issued an Advance Notice of Proposed Rulemaking (ANPR), entitled “Nondiscrimination on the Basis of Disability; Accessibility of Web Information and Services of State and Local Government Entities and Public Accommodations.” That document provides that, “Title III reaches the Web sites of entities that provide goods or services that fall within the 12 categories of ‘public accommodations’ as defined by the statute and regulations.” It also sought input on whether the DOJ should adopt “the WCAG 2.0’s Level AA Success Criteria as its standard for Web site accessibility for entities covered by Titles II and III of the ADA.”
It is the intent of the California Legislature that the building standards published in the California Building Standards Code (Title 24) relating to accessibility by people with disabilities shall be used as minimum requirements to ensure that buildings, structures, and related facilities are accessible to, and functional for, every member of the public, so as to provide equal opportunity to access public accommodations. Access is to be provided to, through, and within the buildings, without loss of function, space, or facility where the general public is concerned.
SDG&E is refusing to approve my new residential solar installation because they require a 24″ clearance in all directions for their gas meter located on the side of my house. They refuse to grant a 4″ variance for one of the solar meters which is located about 3 feet above and to the right of gas meter. The encroaching solar meter would have to be moved 30 feet over a fixed stucco wall which would require me to walk all the way around the house instead of 10 feet to the current location. I would also be required to allow 24hr/7 day a week access to the Solar Company, SDG&E and City workers into my side and rear yards which is an unnecessary invasion of my privacy. If they trip and fall or have any accident as a result of an alleged dangerous condition of my property they can sue me outside of their workers comp plan and my home owners insurer will be required to pay and then raise my rates or drop my coverage. Can I ask that SDG&E grant the 4″ variance based on the ADA and the severe osteoarthritis I have in my hips and knees? I have had 4 surgeries so far and soon will need double knee and hip replacement surgeries.
Since enforcement of the act began in July 1992, it has quickly become a major component of employment law. The ADA allows private plaintiffs to receive only injunctive relief (a court order requiring the public accommodation to remedy violations of the accessibility regulations) and attorneys' fees, and does not provide monetary rewards to private plaintiffs who sue non-compliant businesses. Unless a state law, such as the California Unruh Civil Rights Act, provides for monetary damages to private plaintiffs, persons with disabilities do not obtain direct financial benefits from suing businesses that violate the ADA.
What I suspect you are looking for is advice about how to make your home “accessible” for your aunt and uncle. The ADA and the accessibility requirements of the California Building Code are specifically for “facilities offering goods and services to the public.” As to making your home more accessible, an architect or a good contractor can help you. I live in what is called an ADA compliant apartment complex. All the apartments are compliant but I have only seen the downstairs units. My question is the parking lot. There is only one handicapped space and there is approximately 40 units, is this ADA compliant and legal? If it is declaring to be ADA compliant isn’t there some kind of code requiring multiple handicapped parking stalls.
While an ADA retaliation claim does not warrant compensatory and punitive damages, lawyers are able to pursue compensation for their client’s legal fees, which may range from such amounts as $25,000 to astonishing digits. The court may also issue an injunction for the defendant to make their website accessible to people with disabilities by a specified date. In other cases, the defendant may be forced to pay a civil penalty.
Since the introduction of the Americans with Disabilities Act (ADA) in 1990, physically impaired individuals have been taking advantage of this civil law to protect their rights to receive the same quality of services and products as every other individual. Website accessibility standards were set forth, and it was not long before the first lawsuit regarding accessibility of web services was filed.
Quite a few complaints are based on the fact that many online services can be treated as “public accommodations”, and the ADA protects the rights of physically impaired to receive such services at the same level and quality as everyone else. That’s why entities that provide extra services on their websites that are not available through channels other than online resources will most likely be facing legal claims. That is if their website does not conform to WCAG 2.1 (or to Section 508 for state and government agencies) and has issues that limit impaired people’s capabilities to have full access to the site.
We are also being asked to show the future space for the 1 Van accessible EV space that would be required in the future, if the equipment was installed. And due to the requirement for the access aisle beside this space, in the future it would be converted to an access aisle resulting in the loss of one parking space. As this project is right at the required number of parking spaces per zoning, it is not acceptable to the zoning reviewer to sign off on a plan that shows a “future access aisle for future EV van accessible charging space,” as they are approving the loss of a parking space, even though this would not happen until a future condition, upon which I assume there would be some review process for installation of EV charging equipment. What is the appropriate path forward in this situation?
People with disabilities should be able to easily access the Internet. (You can find a video about how screen readers work here.) But to accomplish this, the DOJ should have issued regulations. It issued regulations for State and local governments. It issued regulations for Federal agencies. Why not issue regulations that would apply to private business? As a point of reference, in October 2016, the European Parliament approved the directive 2016/2102 that requires websites and mobile applications of public sector bodies to conform with WCAG 2.0 Level AA. New websites must comply from 23 September 2019 on, old websites from September 23, 2020 on and mobile applications from June 23, 2021 on. These regulations provided direction and time for business to become compliant.
For close to seven years, since July of 2010, the United States Department of Justice (DOJ) has talked about issuing regulations specifically about web accessibility. At that time the US Department of Justice (DOJ) began developing accessibility guidelines for public websites under Title III of the Americans with Disabilities Act (ADA). On December 26, 2017, the Department announced that those regulations were officially withdrawn.
HRB Digital and HRB Tax Group have agreed to: appoint a skilled web accessibility coordinator who will report to H&R Block’s enterprise Chief Information Officer; adopt a web accessibility policy; initiate training on accessible design for its web content personnel; evaluate employee and contractor performance based on successful web access programming; conduct regular automated and user group testing; hire an approved outside consultant to prepare annual independent evaluations of Block’s online accessibility;
The lack of regulations here has led to the absolute worst-case scenario. People with disabilities have not been served since most companies are unaware this is an issue. Most don’t even realize this is something they have to consider until they receive a demand letter. That has certainly been the case for some of my clients. This leads to a scramble to get compliant. Unfortunately, it can take up to a year to do so depending on the complexity of the site. Meanwhile, plaintiffs’ attorneys across the country are taking advantage of the confusion. More than 260 website accessibility lawsuits were filed in 2016, and significantly more were filed by the end of 2017. But these numbers do not even begin to cover the cases that are settled pre-litigation.
If you live in California, it sounds like the City certainly has some issues that need to be corrected. Both the ADA and the California Building code require accessible paths of travel – which in California, is typically 48″, but can be 36″ upon approval of enforcing agency. I would suggest calling / writing your mayor / city manager & starting a conversation with them.
If you do get sued, if you immediately remediate your website, you may be able to get the lawsuit dismissed on mootness (there’s no longer anything in dispute, i.e. plaintiffs are arguing your website is inaccessible but you’ve already made it accessible). This definitely does not mean you should wait to fix your website but it does mean you may have an out.
In 1986, the National Council on Disability had recommended the enactment of an Americans with Disabilities Act (ADA) and drafted the first version of the bill which was introduced in the House and Senate in 1988. The final version of the bill was signed into law on July 26, 1990, by President George H. W. Bush. It was later amended in 2008 and signed by President George W. Bush with changes effective as of January 1, 2009.

1:15 PM, Nov. 12, 2018 This story incorrectly says that nearly 5,000 ADA lawsuits were filed in federal court for alleged website violations in the first six months of 2018 and that 10,000 were projected to be filed by year’s end, up 30% from 2017. Those numbers actually refer to all ADA lawsuits for disability discrimination involving public accommodation filed in that period. Of those suits, lawsuits alleging website accessibility violations totaled 1,053 in the first six months, a number that is projected to rise to 2,000 by year’s end, up 90% from 2017.
I am hearing impaired with one hearing aide and a cochlear implant in the other ear. It is becoming increasing harder for me to hear on the phone, in fact I have been texting as my first method of communication. On Tues I had a hearing test done, my hearing loss is progressively getting worse. Must cellular companies offer visual texting FREE to people under ADA? I live in CA. I am certified by the State of CA to be legally deaf.
Many members of the business community opposed the Americans with Disabilities Act. Testifying before Congress, Greyhound Bus Lines stated that the act had the potential to "deprive millions of people of affordable intercity public transportation and thousands of rural communities of their only link to the outside world." The US Chamber of Commerce argued that the costs of the ADA would be "enormous" and have "a disastrous impact on many small businesses struggling to survive." The National Federation of Independent Businesses, an organization that lobbies for small businesses, called the ADA "a disaster for small business." Pro-business conservative commentators joined in opposition, writing that the Americans with Disabilities Act was "an expensive headache to millions" that would not necessarily improve the lives of people with disabilities.
Title III also has applications to existing facilities. One of the definitions of "discrimination" under Title III of the ADA is a "failure to remove" architectural barriers in existing facilities. See 42 U.S.C. § 12182(b)(2)(A)(iv). This means that even facilities that have not been modified or altered in any way after the ADA was passed still have obligations. The standard is whether "removing barriers" (typically defined as bringing a condition into compliance with the ADAAG) is "readily achievable", defined as "...easily accomplished without much difficulty or expense".
Access Now v. Southwest Airlines was a case where the District Court decided that the website of Southwest Airlines was not in violation of the Americans with Disabilities Act, because the ADA is concerned with things with a physical existence and thus cannot be applied to cyberspace. Judge Patricia A. Seitz found that the "virtual ticket counter" of the website was a virtual construct, and hence not a "public place of accommodation." As such, "To expand the ADA to cover 'virtual' spaces would be to create new rights without well-defined standards."
