The ADA itself holds different organizations to more/less stringent standards based on a host of factors, government funding being a major one. Government agencies themselves are usually held to the most severe standards. That said, while ADA has adopted WCAG as the defacto standard, from what I’ve seen it appears they’re going with AA compliance as the most reliable one. That said, we’ve done work with some organizations who’ve chosen to comply with AAA in an effort to be as buttoned up as possible from an accessibility and experiential perspective. We’ve also worked with some who have tighter budgers and aim for level A compliance and have a more “react and repair” mindset when they discover anything in their site that is giving someone hardship from an accessibilirt standpoint.
If posted on an accessible website, tax forms need to be available to people with disabilities in an accessible format on the same terms that they are available to other members of the public – 24 hours a day, seven days a week, without cost, inconvenience, or delay. A staffed telephone line that sent copies of tax forms to callers through the mail would not provide equal access to people with disabilities because of the delay involved in mailing the forms.
MAGENTA is a web-based accessibility tool developed by the Human Interface in Information Systems (HIIS) Laboratory within the Human Computer Interaction Group. In addition to the WCAG 1.0 guidelines it evaluates the accessibility of websites according to their conformance to guidelines for the visually impaired and guidelines included in the Stanca Act.
DYNO Mapper is a sitemap generator that checks the web accessibility of websites and online applications. DYNO Mapper includes content inventory and audit, as well as daily keyword tracking. Results are displayed within visual sitemaps to allow for easy and efficient project discovery and planning. Version 1.0 was released on December 1, 2014. Version 2.0 was released on May 22, 2018, and included a Visual Accessibility Tester that shows issues visually in your browser. Version 3.0 was released on March 12, 2019, with Authentication capability for testing private websites and online applications as well as monitoring and notifications. Guidelines covered include WCAG 2.1 — W3C Web Content Accessibility Guidelines 2.1, WCAG 2.0 — W3C Web Content Accessibility Guidelines 2.0, WCAG 1.0 W—3C Web Content Accessibility Guidelines 1.0, Section 508, U.S. federal procurement standards, Stanca Act, BITV, Italian accessibility legislation, and German government standards. The program assists by automatically checking groups of pages or sites, including those that are restricted or password protected, and generating reports of assessment results. Supported formats include CSS, HTML, and XHTML. Licenses are available for individuals, organizations, or enterprise.
It isn’t a problem by default, a lot of it comes down to how it is built. I’d suggest either considering a highly accessible contingency option, or build those components in such a way that there is a level of accessibility baked into it. The Department of Justice may file lawsuits in federal court to enforce the ADA Compliance, and courts may order compensatory damages and back pay to remedy discrimination if the Department prevails. Under title III, the Department of Justice may also obtain civil penalties of up to $55,000 for the first violation and $110,000 for any subsequent violation of ADA Compliance.


"The United States demands that H&R Block is fined a penalty to 'vindicate the public interest' and to award money to the individuals who sued the company. The ADA prohibits discrimination of disability by public accommodations in the 'full and equal enjoyment of the goods, services, facilities, privileges, advantages and accommodations,'" the Justice Department said in joining the lawsuit.
Monsido Web Governance Platform is a platform offered through by Monsido Inc. The program will scan your web site for any web accessibility issues in a format that is easy for those users who are less than “tech-savvy.” In fact, the company states that you do not have to be a web developer or even familiar with web accessibility compliance standards to ensure your site is current and in compliance.
Blind people, those with low vision, and people with other disabilities that affect their ability to read a computer display often use different technologies so they can access the information displayed on a webpage. Two commonly used technologies are screen readers and refreshable Braille displays. As discussed above, a screen reader is a computer program that speaks the text that appears on the computer display, beginning in the top-left corner. A refreshable Braille display is an electronic device that translates text into Braille characters that can be read by touch. These assistive technologies read text. They cannot translate images into speech or Braille, even if words appear in the images. For example, these technologies cannot interpret a photograph of a stop sign, even if the word “stop” appears in the image.

Pa11y is a program offered through the Nature Publishing Group. It monitors the web accessibility of your web sites with the pa11y-dashboard specifically. The most recent version 1.6.0 was released on April 8, 2015, and it covers guidelines including WCAG 2.0 — W3C Web Content Accessibility Guidelines 2.0, Section 508, and U.S. federal procurement standards.
In response to the members’ concern about the proliferation of website litigation lawsuits, DOJ said:  “Given Congress’ ability to provide greater clarity through the legislative process, we look forward to working with you to continue these efforts.”  DOJ is essentially putting the ball back in the Congressional court, where little is likely to happen.
